Sub-rule (4) of Rule 3 provides that the intermediary upon obtaining knowledge by itself or been brought to actual knowledge by an affected person in writing or through email signed with electronic signature about any such information as mentioned in sub-rule (2), shall act within thirty six hours and where applicable, work with user or owner of such information to disable such information that is in contravention of sub-rule (2). The Indian intermediaries have implemented these Rules. However some Industry Associations have requested for a clarification on the words “…..shall act within thirty-six hours…” as mentioned in sub-rule (4) of Rule 3. It is clarified that the intended meaning of the said words is that the intermediary shall respond or acknowledge to the complainant within thirty six hours of receiving the complaint/grievances about any such information as mentioned in sub-rule (2) of Rule 3 and initiate appropriate action as per law. Further, the Grievance Officer of the intermediary shall redress such complaints promptly but in any case within one month from the date of receipt of complaint in accordance with sub-rule (11) of Rule 3. The intermediary should have a publicly accessible and published grievance redressal process by which complaints can be lodged.

One may state the accepted principle of interpretation of a statute that every legislation is prima facie prospective unless it is expressly or by necessary implication made to have retrospective operation. The question whether a statute operates retrospectively or prospectively is one of legislative intent. If the terms of the statute are clear or unambiguous and it is manifest that the legislature intended the Act to operate retrospectively, unquestionably it must be so construed. If, however the terms of a statute do not of themselves, make an intention certain or clear, it should be presumed to operate prospectively. An act is retrospective. If it takes away or impairs any vested right acquired under an existing law or creates a new liability or obligation in respect of transactions already past or creates a new obligation or liability in respect of post transactions

2. Definitions.- In these Rules, unless the context otherwise requires,-(1) “Act.” means the Employment Exchanges ( Compulsory Notification of Vacancies)Act. 1959 ( 31 of 1959);

(2) “ Central Employment Exchange” means [1]( any Employment Exchanges) established by the Government of India, Ministry of Labour and Employment;

(3) “ Director” means the Officer-in-charge of the Directorate administering Employment Exchanges in a State or a Union Territory;

(4) “Form” means a form appended to these Rules; [2]

(5)“Local Employment Exchange” means –(a) in the whole of India except the Union Territory of Chandigarh that the Employment Exchange ( other than the Central Employment Exchange) notified in the official Gazette by the State Government or the Administration of the Union Territory as having jurisdiction over the area in which the establishment concerned are situated or over specified classes or categories of establishments concerned or vacancies; and

(b) in the Union Territory of Chandigarh that Employment Exchange established either by the Union Territory Administration of Chandigarh or by the State Government of Punjab or Haryana notified in that State’s respective Official Gazette as having jurisdiction over specified classes or categories of establishments or vacancies, provided that the employment exchanges established by the State Government of Punjab or Haryana shall not have jurisdiction over—

(i) Public Sector offices/establishments other than those belonging to the respective States: and

(ii) Private Sector establishments.

6. “ Section” means a Section of the Act

Interpretation. -In this Act, unless the context otherwise requires,- (a) "adaptation" means,- (i) in relation to a dramatic work, the conversion of the work into a non-dramatic work; (ii) in relation to a literary work or an artistic work, the conversion of the work into a dramatic work by way of performance in public or otherwise; (iii) in relation to a literary or dramatic work, any abridgement of the work or any version of the work in which the story or action is conveyed wholly or mainly by means of pictures in a form suitable for reproduction in a book, or in a newspaper, magazine or similar periodical;3 (iv) in relation to a musical work, any arrangement or transcription of the work; 4  and (v) 5  in relation to any work, any use of such work involving its re-arrangement or alteration;  (b) "work of architecture" means any building or  structure having an artistic character or design, or any model for such building or structure; 6 (c) "artistic work" means- (i) a painting, a sculpture, a drawing (including a diagram, map, chart or plan), an ngraving or a photograph, whether or not any such work possesses artistic quality; (ii) work of architecture;7 and (iii) any other work of artistic craftsmanship (d) "author' means,- (i) in relation to a literary or dramatic work, the author of the work; (ii) in relation to a musical work, the composer; (iii) in relation to an artistic work other than a photograph, the artist; (iv) in relation to a photograph, the person taking the photograph; (v) in relation to a cinematograph8 or sound recording the producer; and (vi) in relation to 9 [any literary, dramatic, musical or artistic work which is computer-generated, the person who causes the work to be created;] 4. Functions of the Secretary of the Copyright Board. — The registrar of Copyrights shall perform all secretarial functions relating to the Copyright Board under the direction and control of the Chairman of the Copyright Board.

4. The rates of wages payable to the workmen by the contractor shall not be less than the rates prescribed for the Schedule of employment under the Minimum Wages Act, 1948, where applicable and where the rule have been fixed by agreement, settlement or award, not less than the rates fixed.

5. In case where the workmen employed by the contractor performs the same or similar kind or works as the workmen directly employed by the Principal Employer of the establishment, the wage rates, holidays, hours of work and other conditions of service of the workmen of the contractor shall be the same as applicable to the workmen directly employed by the Principal Employer of the establishment on the same or similar kind of work: provided that in the case of any disagreement with regard to the type of work the same shall be decided by the Deputy Chief Labour Commissioner(C) whose decision shall be final.

6. In other cases the wage rates, holidays, hours of work and conditions of service of the workmen of the contractor shall be such as may be specified in this behalf by the Deputy Chief Labour Commissioner(C).

7. In every establishment where 20 or more women are ordinarily employed as contract labour there shall be provided 2 rooms of reasonable dimensions for the use of their children under the age of six years. One of such rooms would be used as a playroom for the children and the other as bedroom for the children. For this purpose, the contractor shall supply adequate number of toys

and games in the playroom and sufficient number of cots and beddings in the sleeping room. The standard of construction and maintenance of the crèches may be such as may be specified in this behalf by the Deputy Chief Labour Commissioner(C)

8. The licence shall notify and change in the number of workmen or the conditions of work to the Licensing Officer.

9. A copy of the licence shall be displayed prominently at the premises where the contract work is being carried on The licence shall, within fifteen days of the commencement and completion of each contract work submit a return to the Inspector appointed under Section 28 of the Act intimating the actual date of the commencement or, as the case may be, completion of such contract work in Form VI-A
